JARU PEOPLE #2 LOSES REGISTRATION TEST
In the East Kimberley, the Native Title Tribunal has refused to register a new Native Title claim.
The Jaru People #2 application was for part of Lamboo Station south of Halls Creek, and the claimants were Elizabeth Jingle, Rosemary Carey, Frank Sampi, Margaret Rogers, and Lena Carey.
Tribunal member Katy Woods said the claim did not satisfy two important conditions in the Native Title Act.
Ms. Woods said she was not satisfied that no person included in the claim group was a member of a native title claim group for any previous application for the same land.
She said maps showed a previous “Jaru People” claim was for land overlapping the area in this new claim, so the new claim was not valid.
Ms. Woods also said she was not satisfied that at least one member of the claim group has or had a traditional physical connection with a part of the application area.
Under Commonwealth law, a Registration Test is the first legal step in the process of establishing Native Title.
